在失能津貼核發前死亡，可以領取死亡與失能津貼嗎?－桃園市企劃從業人員職業工會

家人過去在災保有效期間從事有害作業，退保多年後經職業醫學科專科醫師診斷因執行職務罹患職業病，便依災保法第78條向勞保局申請退保後職業病失能津貼。請問若家人在失能津貼核發前死亡，是否還能領取死亡津貼與失能津貼呢？

勞工申請災保退保後職業病失能津貼後，如經本局審定符合請領規定，但已於失能津貼核發前死亡，遺屬只能選擇承領失能津貼或改申請死亡津貼。

特別注意

家人在災保失能津貼核發前死亡，符合災保死亡津貼請領規定，兩者不可同時請領，遺屬只能選擇其中一項請領。

: A family member previously engaged in harmful work while covered by occupational accident insurance. Years after leaving the insurance program, they were diagnosed with an occupational disease by an occupational medicine specialist due to their job duties. They then applied for post-withdrawal occupational disease permanent disability allowance under Article 78 of the Labor Occupational Accident Insurance and Protection Act. If the family member passes away before the disability allowance is issued, can the surviving dependents still claim both the death allowance and the disability allowance?

If a worker applies for the post-withdrawal occupational disease permanent disability allowance and is deemed eligible by the Bureau of Labor Insurance but passes away before the allowance is issued, the dependents must choose between receiving the disability allowance or applying for the death allowance.

Important Notice

If a family member passes away before the disability allowance is issued, and meets the eligibility criteria for the death allowance, both allowances cannot be claimed simultaneously. The surviving family member can only choose one of the two allowances to claim.
